    Why are you processing my personal information?

    • The DVA driving theory test section processes your information to facilitate the booking, administration and delivery of the driving theory test in Northern Ireland.
    • The legislative basis for the processing of personal information, depending upon test category, is primarily the Road Traffic (NI) Order 1981. (Other legislation related to Driver & Vehicle Testing is available on request to DVA).

    What categories of personal data are you processing?

    The information processed is collected from your completed application form, telephone or online booking and on admission to take the test and following completion of the test and contains the following:

    • Personal information: Name, address, date of birth, gender, ethnicity, Driver Licence number, licence entitlement details, signature, telephone number, mobile telephone number, email address and test result/s.
    • Special Category - Medical details and/or educational details.

    Where do you get my personal data from?

    We will use the information provided by you to enable us to process your application to book a driving theory test, to admit you to take your driving theory test and to issue you with your test result. The legal basis for processing your personal data is Article 6 (1) (e) of the UK General Data Protection Regulations whereby the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller and in accordance with the Road Traffic (NI) Order 1981.

    • The theory test booking system is populated with data transferred from DVA’s Driver Licensing System IT system.
    • Applicants booking a driving theory test provide information via the theory test application form, by telephone to the Customer Service Centre and via the online booking system. This information is verified against the data held on the theory test booking system. Your driving licence details are also captured if you use the image recognition function (This function is not available when booking an instructor theory test).
    • Applicants who require accommodation facilities, to assist them in the completion of their driving theory test, provide medical and/or educational evidence by email or post.
    • Applicants who complete the voluntary customer satisfaction survey provide information on ethnicity and an email address contact.

    Do you share my personal data with anyone else?

    • We may share your personal data with enforcement agencies, for example with HRMC or other agencies with investigative powers, for the prevention or detection of crime.
    • We share driving theory test data with:
    1. The PSNI, for the purposes of the prevention, investigation or prosecution of road traffic related offences.
    2. With the Northern Ireland Courts and Tribunal Service (NICTS) for the prosecution of road traffic related offences.
    3. With the Driver and Vehicle Standards Agency in GB to provide information to enable mutual recognition of the driving theory test.

    How long do you keep my personal data?

    Data transferred from DVA’s Driver Licensing System is kept until the individual is no longer able to drive / or until DVA receives notification that the driver is deceased. Application forms, incident reports and medical evidence are held for 2 ½ years. Query and complaint correspondence is held for 2 years.

    What rights do I have?

    • You have the right to obtain confirmation that your data is being processed, and access to your personal data
    • You are entitled to have personal data rectified if it is inaccurate or incomplete
    • You have a right to have personal data erased in certain circumstances
    • You have the right to request the restriction or suppression of processing your personal data, in certain circumstances
    • You have the right to data portability, in certain circumstances
    • You have the right to object to the processing of your personal data, in certain circumstances
    • You have rights in relation to automated decision making and profiling

    How do I complain if I am not happy?

    If you are unhappy with how any aspect of this privacy notice, or how your personal information is being processed, please contact Department’s Data Protection Officer at the address above.
