Why are you processing my personal information?
- DVA processes your information to facilitate the booking, administration and delivery of the practical driving test in Northern Ireland.
- The Road Traffic (Amendment) Act (Northern Ireland) 2016 makes provision for the introduction of Graduated Driver Licensing (GDL) in Northern Ireland. It amends the Road Traffic (Northern Ireland) Order 1981. The Order provides the legislative basis for the processing of personal information for driver testing.
- The learning to drive programme of training is documented and evidenced in a Logbook which must be completed and verified before you can sit a practical driving test. The Logbook and Programme of Training are delivered through an e-learning app and/or website.
What categories of personal/additional data are you processing?
The information processed is collected from your digital Logbook and contains the following:
- Personal Information: Name, address, date of birth, mobile telephone number, e-mail address, driver licence number, e-signature, Approved Instructor number (where relevant).
- All information inputted into the application, including in free text areas by the user, detailing specifics of training undertaken. E.g. date, weather, lighting conditions, urban/rural roads, duration of training, commentary etc.
Where do you get my personal data from?
The Logbook is completed by you and your supervising driver(s) and/or Approved Instructor(s) either via the mobile app, and/or website. This provides the evidence that you have progressed through the programme of training. You provide DVA with access to the Logbook so that we can verify that you have completed the programme of training in preparation for the practical driving test.
The personal information provided via the mobile app or website is checked against information you provided with your application for a provisional driving licence. We will also check DVA driver licensing records to verify that the supervising driver(s) and/or Approved Instructor(s) responsible for signing off your programme of training meet the criteria. Where the supervising driver is an approved driving or motorcycle instructor, we will also check DVA records to verify that they are registered.
Do you share my personal data with anyone outside of DVA?
- We may share your personal data with other government agencies.
- We share data with:
- The PSNI, for the purposes of the prevention, investigation or prosecution of road traffic related offences and other appropriate authorities within the EU.
- The Northern Ireland Courts and Tribunals Service (NICTS) for the prosecution of road traffic related offences.
- With the Department of Finance’s Account NI to process manual refunds.
Sharing and transfers: Routine access will be limited to DVA personnel who require it for eligibility checks and to Approved Instructors for verification of learner data. No wider external sharing is envisaged. Inter-system data transfers will use a pull data model retrieving necessary data directly from B&R, DLS and AIS into GDL secure environment.
Do you transfer my personal data to other countries?
Sometimes it may be necessary to transfer personal information overseas. When this is needed, information may be transferred to countries or territories around the world. Any transfers made will be in full compliance with all aspects of the GDPR.
How long do you keep my personal data?
Data transferred from the Logbook is held for 5 years. The disposal and retention schedule for personal data held by DVA, is outlined in the procedures relating to the Storage of Records. This information is available on request from DVA.
What rights do I have?
- You have the right to obtain confirmation that your data is being processed, and access to your personal data.
- You are entitled to have personal data rectified if it is inaccurate or incomplete.
How do I complain if I am not happy?
