Why are you processing my personal information?
- DfI Rivers process your information to administer the issuing of leases and the regulation of the Lough Erne Estate, County Fermanagh.
- The legislative basis for processing this information is The Drainage (NI) Order 1973 10 (1) (d) &
- Article 6 (1) (c) & (e) of the UK General Data Protection Regulation.
What categories of personal data are you processing?
The personal data processed by DfI Rivers consists of the following:
- Personal information: Name, Address, E-mail, Signature and Contact Phone Numbers
Where do get my personal data from?
The information processed is collected from your completed application form and any notifications received during the lifetime of the lease. We will use the information provided by you to enable us to process your lease application. The legal basis for processing your personal data is Article 6 (1) (e) of the UK General Data Protection Regulation whereby the processing is necessary for the performance of a task carried out in the public interest or in exercise of official authority vested in the controller and in accordance with the Drainage (NI) Order 1973.
- Applicants provide information on the Lough Erne Estate Lease application forms.
- Where necessary we may verify other information with third party sources including Land and Property Services.
- When leases are due to expire, the lessee will receive a renewal notice containing information relevant to their lease and providing information on how to renew the lease.
Do you share my personal data with anyone else?
- We may share lease data with enforcement agencies e.g. PSNI or other agencies with investigative powers as part of the National Fraud Initiative for the prevention or detection of crime.
- We share lease data with Departmental Solicitor’s Office for the legal processing of lease agreements
How long do you keep my personal data?
- Leases take on average six months to complete. The Department maintains a lease register which is updated with leases issued, including copies of application forms and documentation submitted to support your application. Your personal data is retained by the Department for the lifetime of the lease. On average, the lifetime of a lease is 49 years.
- This is in line with the Department for Infrastructure’s Retention and Disposal Schedule. Section 1.3 states that leases/ title deeds shall be retained for the lifetime of the lease, and permanent retention by the Department until the asset is disposed of.
- Personal details held in relation to a lease agreement will be checked for accuracy every year, during invoicing time.
What rights do I have?
- You have the right to obtain confirmation that your data is being processed and you have access to your personal data.
- You are entitled to have personal data rectified if it is inaccurate or incomplete.
- You have the right to object to the processing.
