Consultation description

The purpose of the consultation was to obtain views on a specific amendment to the Hazardous Substances Regulations.

The Hazardous Substances Regulations apply the Seveso II Directive (Directive 96/82/EC, as amended), to the planning process in Northern Ireland.  The Seveso II Directive requires that the objectives of preventing major-accidents involving dangerous substances are taken into account in land use planning policies.  The Seveso II Directive was amended by Article 30 of the Seveso III Directive on 14th February 2014, adding heavy fuel oils (HFO) as a specific named substance in Annex 1 with a threshold of 2,500 tonnes.

The draft Regulations amended the Hazardous Substances Regulations to give effect to Article 30 of the Seveso III Directive, by adding “d) heavy fuel oils” to the heading “Petroleum products” in the table in part A of Schedule 3 with a controlled quantity of 2,500 tonnes.
