Information access (FOI) complaints

Part of: Information Access

Our commitment

While the Department for Infrastructure will try to meet your information needs, there will be occasions where we will not provide you with what you want.  We will try to explain to you the reasons why the information is not provided, and we will explain any exemptions or exceptions applied.

You have the right to complain about the handling of your request, and you should be told the complaints procedure for your request in our response.

Data protection complaint

For those unhappy with the handling of requests made under the Data Protection Act, complaints should be directed to the Information Commissioner's Office.

FOI/EIR complaint

If you are unhappy with the handling of a request made under the Freedom of Information Act or the Environmental Information Regulations you should write, within two months, to the DfI Departmental Information Manager (DIM).  The DIM will conduct an internal review (a reconsideration under EIR) of the processing of your request.

How long will it take?

The Department tries to ensure that all reviews will be completed within 20 working days. However, in exceptional circumstances, a review may take up to 40 days.

Still not satisfied

Should you remain unhappy, following this internal review, you should contact the Information Commissioner's Office (ICO).  The ICO will carry out a further investigation of the Department's handling of your request and of your internal review.
