Overview of Planning Enforcement Responsibilities

The ‘Overview of Planning Enforcement Responsibilities’ advice document was published by the Department for Infrastructure on 31st October 2016. It provides an overview of planning enforcement responsibilities in Northern Ireland and seeks to inform those engaged in the planning system that a council has the primary responsibility for planning enforcement in its given administrative area.

It highlights the planning enforcement powers and responsibilities of a council and the reserve powers of the Department, strategic policy relevant to planning enforcement and the requirement to be in compliance with European Union legislation and associated regulations in relation to the planning enforcement process.

It also refers to the Planning Enforcement Strategy of individual councils, making a complaint about an alleged breach of planning control and the enforcement of planning permissions granted by the Department.

Further advice on procedures and practices associated with a wide variety of planning matters, including enforcement, is available in the Planning Practice Notes.
